The guidance on the gov.uk site is quite detailed

If you meet most of the criteria listed here then they don't count as employed ie they are not working
https://www.gov.uk/au-pairs-employment-law/au-pairs

So if the au pair criteria are met = not working = no cert needed

Otherwise if they are studying while here and want to do 20 hrs work then it's the yellow cert & they apply while here

Hi

We have found a lovely Croatian au pair but are confused by work permits and would love to sort it out before their arrival. Has anyone already been through this?
Croatia is in the EU but Croatians who come here to work need a work permit. But an au pair isn't employed or "working", just hosted- there is no category in the long list of permits that fits for au pairs. The potential au pair says friends just come here as tourists and no one asks but I don't want to get into trouble. Happy to apply for a permit if I knew which one! I emailed the BAPAA and they said it isn't clear and they don't know. Before Croatia joined the EU the au pair could apply for an au pair permit for 2 yrs with no difficulty at the UK border but now that doesn't exist. I emailed the Croatian British Embassy and they haven't responded. Does anyone know?
Sorry this is a dull post but you'd be doing me a big favour if you could set my mind at ease on this one. Thanks!
