Hi there OP

Hope you've had some progress regarding this (unjust) issue!

This kind of thing really gets on my wick. I'm investigating some nurseries for my nieces that are due over here next year. What is the name of the nursery? I'd love to know who to avoid!

Just to respond to Sw17mamma's point a post but one ago: I think we all agree that if they can't fill the space then you forfeit the deposit. The point here is that the nursery in question (like I would expect the majority in nappy valley) probably WILL fill the space in which case if the deposit is not returned this would put them at odds with the law on penalties and unfair terms in consumer contracts regulations as Pie81 pointed out in an earlier post. I really hope someone out there who has found themselves in this situation eventually puts this to the test - it's a real racket as far as I'm concerned!

...and at the very least, if the place is filled, the first terms fees should not apply!

What about getting a friend to ring and ask if their child can start in September. If they are told it is full, then you have a firm basis on who h to argue.

Please PM me with the name of the nursery. I don't like the sound of how they conduct business and certainly wouldn't want to use their company when they treat their customers so unreasonably. I don't like the idea of leaving my nieces with a company that is so obviously lacking empathy - not to mention possible "posing" as a NV mum! :evil:

This scam has been ongoing for years with many of the more money grabbing schools but unfortunately is normally in the legal Agreement.

What does your Agreement say?

Have you done as suggested and checked if they are indeed full because this is the real hard point, if they aren't it is a loss that you must cover.

If they have suffered no loss I would suggest challenging the bill, first in a pleasant verbal way, secondly in a polite but firm written way, and third probably wait for them to get very stroppy indeed before you pay them.

It is unlikely to be worth the risk of going to law over £2,000 however abused you feel.

When you get clear of them, I think it is perfectly fair to expose this in a purely FACTUAL way, don't slag them off, just describe the facts of their Agreement in practice.

We have exactly the same situation with <name removed by moderator at original posters request>!

The owner <name removed at poster request> seems to be very inflexible in terms and would not agree to wave even part of the sum.

The problem is that we were on the waiting list in the local preschool and luckily got a place only in July which was after the last notification date (T&C required to give 1term notice). The situation was out of our control and I imagine that 2.5 months during July-Sept period would provide more than enough time to fill the space however <name removed at poster request> seems to have a different opinion and we have to abide by the rules and were requested to cover:
- football and ballet extras (although its optional)
- even for 3 free hours (as they might not get another 3y.o.)

Plus they have very long holiday period of 20weeks and are only open 3 hrs a day anyway!

I guess private nurseries are a business, and not a charity, but if you have any words of advice, it would be greatly appreciated!

So sorry to hear of your situation. Awful, isn't it?

No words of advice, sorry. My nursery in question did not waive anything either and when I didn't receive the invoice to my new address, they sent me an email threatening "If this fee is not paid within the next seven days, you leave us no alternative but to send this to our school recovery team of lawyers.".

So on top of everything, they were threatening ruining my credit rating as a result!

I still haven't receive the invoice in the post despite giving them my new address again but I have received it via email so I must now pay it. Ridiculous.

Hoping karma will bit the owner of the nursery in the bum.

A similar tale here, though for slightly different reasons.

My daughter was at a local nursery, and she has non-ige allergies to soya, dairy and egg. The nursery were told not to feed her these things, I provided medical reports to back this up, and gave a detailed summary of her history and how her condition (it's part of a larger condition) affects her.

Yet, on two (possibly three) occasions, the nursery were vague in what they'd given her to eat .....

"noodles"
"those noodles?" (plate in front of me)
"yes"
"they have egg"
"errrr, no, not those, she had *nudging one another* special rice"
"what brand?"
"errr"

And on it went. My daughter was violently sick on two occasions, she's old enough to tell me what she ate and when she did tell me, it was something she shouldn't have. In fact I saw it for my own eyes, on the way back up shall we say (!!!). Yet they disputed it.

Needless to say, we left, and put her somewhere that could cater better to her needs.

She'd been there 12 weeks, tops. Yet we were charged the registration fee (fine, we had accepted that) but one month's notice too - despite us feeling hugely uncomfortable with leaving our child there, and despite them ever (still to this date) telling me/her consultant/her dietitian exactly what she'd eaten to make her so unwell. We even paid that, we aren't ones for confrontation and we were more concerned for our daughter's health frankly. £600 down at this point. Still no replies to emails, still no word on what she'd eaten, still no results of the'r 'investigation into the incidents'.

Then, they call me, at work, to say we owe £78 more.

I can let you imagine my response. Utterly furious.

Sounds like criminal negligence to me.

Ask for last term fees and all deposits to be returned. Get a lawyer friend to write the letter.

You should have kept the upchuck in the freezer!

I'm pursuing it. Awaiting a reply from someone higher in the company, and depending on what she says I will be thinking of doing something along those lines.

Being unable to say for certain what an allergic child has eaten whilst in their care is just not on.

Then charging the parents a fortune for the 'pleasure'.

She's now at a nursery who, whenever they even do any food-related activites, send me home a list of all ingredients they'll be using in advance to check she's ok with them. Without me asking. Without making me feel like an over-anxious mother. Thank heavens for the good ones.

At the end of the day, these are businesses. I would think you would be very disappointed if you gave a deposit and they did not give your child a spot because 'unforeseen circumstances' came up and they gave it to someone else. That is why we have contracts and deposits to protect both parties interests.

I have given 2,500 for next year's school and if I leave town, then that is my fault. But, until then I have the confidence I have a secured place.

I would expect ALL nurseries to uphold these contracts/deposits, because what is the point of them if they can all be broken. It is business, not personal.

@ Bubs, please do "share" the name of that nursery so that none of us can ever use it, that is so shocking, what about peanut allergies etc? would they be vague on those?

I rather got the impression that because my daughter's allergies were not anaphylactic, they didn't get the focus they perhaps should have.

I'll let the nursery managment respond to my communications first, before I take the matter further, or name them. I think that's fair. They have said so far that an investigation has shown that they followed procedure correctly, but to my mind they have been unable to demonstrate/prove this sufficiently to me.

balhamorbust please read the post - they are in clear breach of duty of care and probably criminally negligent.

The Contract isn't going to stand the test of reason in this case and reason is the law
