Help!!!- Need a good lawyer!!!

Postby sunshine1 » Thu Jun 02, 2011 4:31 pm

Hello,
Can anybody recommend a really good family lawyer???

I am desperately in need of instructing a really good lawyer with regards to child maintenance.
My ex partner is refusing to pay maintenance in accordance with his earnings. He has a porftolio of properties, goes on holiday, drives a 4x4 car, and claims he has no money!

This has carried on for 2 years now, and cannot deal with the stress of it anymore! I lost my job last year, and not earning.
The only way to resolve this is to go to court.
Has anybody out there experienced the same problem? I don't doubt for a second, that some of you have.

Don't know what your budget is Sunshine 1 - and mention it only because this firm tend to deal with high-net-worth individuals - but I recommend David Ruck at Gordon Dadds. I wasn't seeking advice - I worked with him some years ago - but he's quite a high-profile family/matrimonial lawyer and a lovely bloke.

The lawyers who got me a very good divorce deal were Charles Russell - they have an excellent Family division, but are quite pricey.

Hi Sunshine 1. I am a local mum and work at Ziadies Solicitors which has offices in Brixton and Victoria. My field is Wills and Probate but I have lovely colleagues, TIshani and Pamela who work in the family department and would be happy to help you. As we are a local High Street firm our charges are not as high as firms which are based in the West End or the City and we give a very personable service. Feel free to give us a call at 02077370934 and ask for either Pamela or Tishani who will be happy to help you. The best of luck as I know it is really tough to go through what you are and very frustrating. I hope we can help you get what you deserve for your child/children. ;)

Hi
Juliet Adelman at Atkins Hope Solicitors. I've not used her services myself - she is a friend, but I have suggested her to other people who have found her to be extremely good. She is able to offer out of hours meetings if needs be too.

email: ja@atkinshope.co.uk or telephone 020 8680 5018

Good luck, I hope you can get things sorted out.

Hi Sunshine 1. It is me again. I spoke to my colleague, Pamela, who told me that it is not solicitors you need to instruct in this case but the Child Support Agency direct as they exclusively are able to chase payments etc. Their details are as follows:
http://www.csa.gov.uk and their telephone lines are open 8am to 8pm Monday to Friday and 9am to 5pm Saturday - Telephone: 08457 133 133
I hope that helps.
With kind regards,
Louisa

I agree with the above post. Don't go to the CSA at this stage - you will get the minimum which is peanuts. I have been in a 2-year long divorce and my lawyer wasn't particularly good (although recommended by one of the top London lawyer firms because I couldn't afford to use them).

I will probably be in the same situation as you soon (as my ex is threatening lowering my maintenance and is claiming poverty, etc. as they do!). If I have to find another lawyer, I will go to 'Rosemary Hensby' based in Goring, West Sussex. A '**** from hell' so I'm told by two separate friends who have used her. Apparently she is an excellent family lawyer, 'a real toughy'. I will definately need someone like her to deal with my extremely difficult, awkward former husband who used to earn over £110,000 pa and now claims his earnings are £20,000 pa. Even though Rosemary is based in Sussex, it doesn't matter. You will need to go there for one appointment, and the rest is dealt through correspondence.

Hope this helps and good luck. Let us know how you get on.

Sorry to hear about your situation - it's never easy. I definitely wouldn't contact the CSA first. You need to instruct a good lawyer on your behalf, this way you can ensure that you get the right entitlement to money based on his income, assets earning potential etc etc.....Personally I think the CSA are a waste of time but apparently they have got their act together over the last few years since I had an experience with them! I have also had a personal experience with Gordon Dodds Law firm & they have good solid matrimonial/ family lawyers that could hugely help your situation as they did mine. I wish you all the best.

Hello lovely ladies,
THANK YOU ALL SO MUCH FOR YOUR WORDS OF WISDOM!

It sounds like some of you have all gone through the pain that I have been going through. I would love to answer to you all personally, but I have a small toddler in the background that won't allow me!

Just to summarise I did all the ground work with the CSA they were completely useless if im honest. He managed to dodge them, and they made a nil assesment. He was in the city and used to earn 250k PA, and he claims he has no money. He is no longer in the city, but has other forms of income. In the meantime as previously mentioned his lifestyle is inconsistent with his earnings! He is blatantly taking the p*ss!

I have tried to be reasonable on every level, tried to be amicable, and almost tried to be friends for the sake of our child. he always manages to let me down, and refuses point blank to contribute more than the the 200 quid that he currently gives. This is also, as and when he pleases and I have to practically beg him every month. He has no empathy or consideration for anybody other that himself! He has a huge huge problem paying the maintenance. All to do with being the control freak that he is!
In the meantime he has managed to have another child, which makes things harder, as i know that child will never be compromised!

I lost my job, over the stress of this situation, a high profile job, which I enjoyed, but I couldn't hack it with the emotional stress i was going through. I was practically just turning up to the office, and not performing. I am now struggling to find work.I blame him, he shows no sympathy! I have told him I am struggling and our child is being compromised, but he dosent care! I continue to pay for a private nursery a couple of times a week, as my child thoroughly enjoys it, but also I cannot afford to lose her place! This is in excess of 600 pounds pm and he had never contruibuted to that either.

I
For the record we are not married, and both own our own properties. He owns several! He is however on my childs birth certificate and wants to be involved in my daughters life. What he dosent want is to share the financial responsibilty. Everytime I bring the subject up of money, he claims he cant afford it! This as we all know, is rubbish!
I did speak to a lawyer very briefly last year, and I am aware if taken to court, we could negotiate a lump sum. This will absolutely freak him out. He would be a million times worst off. I have tried to be reasonable, but he wont play ball. The other thing is he is one step ahead of me, and would of done all the ground work to protect himself. I am more than aware, that some of his properties are not in his name,. Very difficult to prove that he generates an income from these. I think he is more than prepared should we end up in court. Nothing fears him!

I will have this battle for the next 18 years if I do not take this to court. I am dealing with the most unreasonable human being there is out there!
I am not prepared to sit back and let him take the mick out of me!
It is ruining my life, I cant move on, and im angry al the time. I do not like the person I have become because of him! It consumes all my energy!

Thankyou all for the recommendations. I will be contacting all of them for a chat. I will feedback to you all how I get on!

I am currently way abroad, to get away from it all!

Chat soon
Sunshine!

I used to be a family solicitor but haven't practised fro a few years now. I see you have been given lots of recommendations but I would use Justin Moss of Moss Fallon Soliciors who specialise in family matters (0)1672 542 120 www.mossfallon.com
