Solicitor for a Japanese knotweed dispute? Post Reply

Hello everyone
We are having a dispute with our neighbours about Japanese knotweed coming from their garden into ours. It’s been treated for about 7 years but not completely eradicated.
So we are now asking that the affected patch in our garden be completely excavated and protected from the neighbours’. They refuse and say they will just continue fund the treatment.
So we are looking for a solicitor to advise on prospects on making a claim against them to pay for the excavation.
Anyone has come across something like this? Recommendations for a specialist solicitor would be great

Try Gregsons in Wimbledon - not Japanese knotweed specialists as far as I know, but a very good sensible property practice.  And they are honest - if they can't help they will say so.

I sympathise. Best practice is as you have outlined- all the affected Earth must be excavated and removed. Then Annual checks paid for. Dogs are used to sniff out any re-growth.
Oddly, the government has dropped regulations around the issue.
Our solicitor, Nick Green at Quinta Law, addressed this for us with a recent purchase and got the owners to pay for the ‘dog’ survey. You might try him.
Advice online varies enormously but no re-growth after10 years is considered safe.

We recently viewed a property with an apparent spread of knotweed in the neighbouring garden and have been mulling over putting an offer in but quite concerned about ongoing issues both with the weeds and the neighbours.

Did you know about the knotweed before you moved in and did it affect your mortgage and insurance?
