Legal advise needed: Mat policy changes

Postby freddiefox » Sat Mar 21, 2015 7:03 pm

Hi,

I wonder if anyone has experienced this and, if you are able to, please recommend a legal adviser, who could help with my current situation, that would be really helpful.

I am currently on maternity leave, and since being on leave, the company Maternity Policy has changed. I am not sure whether it is applicable to me, given it was not the same before I went on leave. The company is now asking for people on maternity leave to pay back the 6 months additional pay if the individual resigns within 3 months of returning to work.

I need to find legal assistance who can advise me as to whether I am exempt from this, as the new policy was issued while I am on Mat Leave.

Many thanks!

I'd suggest you ask your HR department at work first. If they give you the "right" answer then you wouldn't need to take further advice. I know when my work changed their policy if you were already on mat leave or had announced you were pregnant, the new policy didn't apply unless you asked to take the new policy. But am afraid I don't know whether that is a legal requirement or not...
