You definitely need to consult a lawyer. The pregnancy adds nothing to my advise as it seems like a dodgy redundancy and with knowledge of TUPE, the first poster is right. As for being pregnant, my advise is to do what you are most comfortable with and seek advise from legal. Take care and I hope you have a wonderful pregnancy and good result at work.

Sorry if I sound naive but why not telling your boss you are pregnant? They cant do anything to a pregnant woman, then you can take your maternity leave early on (in my company ity was as early as 15 weeks before the due date so check with your HR) and that way you get your maternity pay. After that up to you to decide to resign or not (you would still be entitled to your maternity leave AND holidays).

Hi thanks so much for your reply. I think I may be getting just over emotional about it all, but you are quite right about the "consultation period". I have been referred a couple of people to talk to so thank you so much maybe that is my best option.

Hi, you very, very urgently need to see an employment solicitor. I am not giving you any legal advice, but the instant issues to me would seem:

- has there been any redundancy process - ie have they had a series of meetings with you, consulted you or otherwise engaged with you about this? If not, your dismissal may be automatically unfair - the solicitor could tell you.

- you may also have a claim under TUPE - only an employment solicitor can advise you, but your employment may shift by operation of law to the new service provider.

If you want some names, I can PM you with two that I know people have used. I don't know if they're good, but they seemed OK to the people who used them.

Redundant and pregnant

Hello, am kind of hoping that someone would be able to guide me as to what I could and should do here.

Rather than go into too much detail my situation is that I have been told by my boss that come Friday I will be made redundant. I have been with the company for over 5 years, (only entitled to statutory) my issue, well not an issue, obviously over the moon, is that I am 18 weeks pregnant with my 2nd and I haven't told anyone at work. Reason being is that the account I work on is moving over to another company in January which I thought I would automatically move over to too, which i have now been told I am not guaranteed a position there at all.

So, do I tell the CEO (who is going to make me redundant that I am pregnant, as I won't get maternity pay now ), tell my client that I am being made redundant and see if he can guarantee me a position with my boss or thirdly just keep my mouth shut about being pregnant and just accept that am being made redundant and no one is going to employ a pregnant woman.

Morally I know which is the best option but I also have to think financially on this, it would mean taking my son out of nursery which he loves as I can't justify him being there when I am not working anymore.

Would really appreciate it if anyone has been in a similar situation to let me know what they did?
