House Repossessed

Postby Jojobay » Thu May 16, 2019 6:54 am

My Mother’s house was repossessed when her husband died suddenly leaving a huge mortgage and other large debts that she couldn’t pay. The house has been sold by the bank and she has now received a letter from a debt recovery agent advising she owes £305,000 from the shortfall. She has no assets and is supported by her children.
Can anyone advise what she should do next? I think she thought handing back the keys would be the end of a very sad story!

Please tell her to go to the citizen’s advice bureau as they can help her on all of these matters. Wishing her the best of luck.

We need more information to comment. To whom are the debts owed - the mortgagee who repossessed the house or a variety of creditors? Are the debts in her husband’s name or in their joint names? If the latter, was her signature forged or did she voluntarily take the debts out?

JoJoBay.

Just to add as long as she is living in the area, I presume that would cover living with her children whom live in the area. Then she would be eligible for debt advice. If you click on the link AM I ELIGIBLE it reads:

AM I ELIGIBLE?

If you read these pages and are still not sure whether you will be eligible for funding, or you know that you will have problems establishing proof of income, call us on 020 8767 2777.

The legal representation we provide is funded (in most cases) by the Legal Aid Agency, under the Legal Aid Scheme.  To be eligible for Legal Aid, you will usually have to pass a means test, set by the Legal Aid Agency (LAA), by showing that your income and capital are within the current financial limits set by the LAA.  This will involve your providing proof of income at your first appointment.

To check whether you may be eligible for funding under the Legal Aid Scheme, follow the link to the Gov.uk Legal Aid Eligibility Calculator.

Our Debt work is funded through the Money Advice Service. There is no means test.

Our Housing Court Duty Scheme requires you to provide information about your income, but there is no means test to be eligible for the service.

There are no eligibility criteria to access our advice clinics – but they are aimed at individuals who cannot afford legal advice.
