Agree use your local County Councillors.

I live in Surrey and my local councillor took on some local cowboy clampers. He then highlighted the issue to local MP Michael Gove who took to David Cameron who changed the law. Go for it!

I am so pleased I found this thread

My best pal who has been using this car park since 1994 (he lives locally in SW2) and is disabled and a blue badge holder - he always parks just to pick up or drop off his Carer at the station who arrives by train.

Parking was originally free for this and also free for blue badge - Until, as we know fairly recently and charges were applied with a 10 min drop off being free.

A local person using this car park for many years would not necessarily think or notice any new signs or ruling on free time changes and or charges unless decent signage was in situ which we know was not.

So he got 2 parking tickets one after the other in January - both PCN's had photos only with his departure time but the arrival time is not showing - On both occasions the trains were delayed and my friend had stayed just over 10 minutes on both visits to pick up his carer.

We have called the shopstop site manager Stuart who confirmed the signage in January was incorrect and also emailed JustPark - We sent a letter into the enforcement company who refused to waive tickets despite a full and concise explanation - Now been to appeal which was also refused - no one is listening.

What do you suggest we do now ??? - my friend says just pay them but I said no we need to fight this.

Another user here hit by these penalties !  I have appealed unsuccessfully and I am now being "threatened" by CPM with High Court Enforcement.  

I have now paid as frankly I cannot afford to litigate this although I feel very strongly that their practices are not only immoral but also illegal.  Clearly they did not make the changes to their terms and conditions clear given the number of posters that have had the same issue (and a large number of friends)

The only other suggestion I have is complaining to Just Park = help@justpark.com - to let them know.

The hill approaching the station is now crazy at pick up with a large number of cars refusing to enter the car park.  As far as I can see the car park now seems to be empty most of the time !

I have passed this thread to my friend and CLJ action group 

JustPark will not intervene nor assist to waive the tickets - they say they only sub lease the car park from the owners and JP get a %commission on the parking tickets (and the fines?)
The car park owners have sourced the enforcement company and it is they who will not accept any appeals for a waiver on any ground it seems - they are sharks - we are trying to appeal again...
failure to that I suggest we send them £30 for their admin costs plus £3 parking for the 2 overstays and tell them that's it and take us to court if they want

rog747 thank you for your post. If you google IAS it will show that this is not an independent service after all !  The IAS is owned by the parking companies and apparently any appeals to the IAS are futile as they will never rule against the parking companies.

The IAS is administered by the International Parking Community (IPC). The IPC is a trade body representing the interests of private parking operators.

According to this thread UK CPM are the most litigious of operators.  According to other threads it is safe to ignore the PCN. 

It seems clear that the signage changing the maximum 10 minute drop off time was not clear and not sufficient given so many of us had the same issue ?  Really not sure what to do next.  I am not sure I have the nerve not to pay !

I have a County Court claim against me filed by Gladstones for this car park form December 2018. 

May Iask whether anyone has successfully appealed in the same position for this car park? IOf so what was the evidence your used to overturn their claim?

This company is a well known bully - they will threaten all the way to the ombudsman but they always cave before getting there... there is no way they can win this one - just stick to the facts
(1) they have not provided evidence to you of overstay because they cannot prove entry time
(2) they cannot evidence that you were “parked” rather than just waiting on the side and not in a parking space - there are only cameras on the entry/exit gateway not inside the car park.
(3) signs do not say anything about no waiting.

Keep going - there should be no charge to you if taking it through established appeal channels - and they will roll over before then anyway they always do - they just rely on people being scared or too busy to pursue it. Bullies.

I am in the same position Memphis73.  I have not heard from Gladstone since November and am still waiting a Judgement date.  I am hoping they will go away.  I have had some legal advice on the matter as this is the first time I have done anything like this but having done a lot of reading on Gladstone and on CPM I feel that I need to go through with it.  They are a bunch of immoral thugs and i feel strongly that what they did at Clapham Junction was wrong.  

I don't dispute that the signs have now been updated and the 10 minute maximum waiting time has been made very clear - but there were no signs indicating a maximum waiting time a year ago when we all started getting fines out of the blue !

I too have been disputing a PCN from Dec 2018. I have all the photographic evidence of the before and after signage. After receiving a number of letters from DRP and one from Gladstone’s threatening Court, I telephoned DRP to inform them that I would not be paying and that they could take me to Court. I haven’t heard a word since and that was Sep 2019. If anyone wants my photos, please pm me.

We 'won' our argument with UK Car Park Management last year, after a similar case of insufficient notices re free waiting time etc. We responded to all their letters (which were largely computer generated) asking for proof that the signage was sufficient at the time of our 'offence' which they never provided. They then threatened the County Court and adverse impact on our credit record, to which we responded in writing that the only way this matter could impact on our credit record would be if they managed to convince a judge that they had a valid claim and we THEN declined to pay. We went on to say that in the unlikely event that they would be able to convince a judge of the merits of their case, we would of course pay, but would vigorously contest any proceedings that they might consider bringing, and would seek to recover our cost. Basically, 'See you in Court'. We received a letter six weeks later that they had cancelled our parking charge notice as a 'gesture of good will'. Hope that helps.

They offer ten minutes free parking at that location & although the car park is managed by Justpark it’s operator is CPM a dodgy bunch if you ask me? I received a PCN for a alleged overstay as I was waiting in the carpark for 19 minutes for an overdue train? I appealed and lost as the adjudicators agreed with CPM so I complained to the DVLA and Won as they have to allow for a minimum ten minute grace period to leave the carpark after the 10 minute free parking event?? Anyone who has had a PCN for a stay of less than 20 minutes should complain to CPM and mention that they are entitled to the IPC grace period

Hello, just received a notice, from two week ago,  while dropping my two children to the station (not in rush hr, car park empty, as we are in lockdown) but, since i walked them to the platform when i dropped them off (they are 10 and 12) and waited until the train came, i was there for 25 minutes, as the train was delayed 10mins, and i got them to the platform a few minutes early, to be safe. Am i able to contest a 25min time? I was 'dropping off' and not parking, but i am over the allotted 'drop time'? If i am able to contest, and i fail (and by the sounds of things i will fail), does that mean the charge will go to £100? Usually in parking fines, with council it stays at same price until contestation is finished, however, it doesnt mention that at all on the notice i have had from CPM (UK Car Park Management). thanks,

Normally parking companies can pursue you for the money for SIX years. But as it is a railway property under the bylaws can only pursue for six months. So you play a waiting game never disclose the driver only reply as the keeper no matter what they say or reply to any debt collecting company (DRP-Zenith same company trying it on!) by letter or by phone ever, they are third party to the debt and have no power to take you to court, you cannot get a CCJ unless court fines you and don't pay in 28 days nor can any Ballif call no matter what letters say. Everything must be done in writing and in this case, play letter table tennis with a maximum delay between each letter until six months is up.
