Pregnant nanny

Hi all, I'm a live in nanny for two little girls in clapham and am three months pregnant. I told my employer 3 weeks ago as I was getting very bad morning sickness. I was hoping at that point we would talk about my job and what will happen but instead she has brushed it under the carpet. I know it is early days but I would really love it if someone had any advice or ideas on my rights as an employee. I know that it would be illegal for her to fire me on the basis that I am pregnant but could she fire me on the basis that I would be living out and she wants someone to live in? Any advice on this and maternity pay ect. Would be greatly received. Thank you

Hi There, I was nannying and got pregnant but i was already a live out nanny so it was different. Unfortunately if you decide to live out then yes she can ask you to leave as she requires a live in position and you can no longer provide that for her. If you decide to stay in the position until you go on maternity leave then you are entitled to get maternity pay from her which she pays but does get back so she wouldn't be out of pocket at all. If you need to check out about maternity pay go to nannytax.co.uk . You will only be entitled to maternity pay though if you stay with them until you would go on maternity leave ( ie until your about 8 months pregnant). If you left the job and went to another one you wouldn't be entitled to maternity pay from them as you were already pregnant when you took the job. You will of course get the government maternity pay.
She also needs to keep your job open for you but only under the conditions you work now ie: live in which i don't expect you will want that.

The lady who posted above is right..I too was pregnant & nannying...I was live out also...so as long as you stay in the job until your maternity leave your boss cannot fire you..she will have to pay your maternity pay..& does claim that back...ring Nanny tax as they were very helpful to me regarding how much holiday pay I was also entitled too..because you do accumilate holiday pay when you are on maternity leave..its something like 1 1/2 days per month..but do check..Good luck

So does the employer in effect not pay anything for maternity pay as it all gets paid back by government? Is that right or does the employer still need to pay the first 6 weeks 90%? Do you know how much need to be earning to qualify?

Just a couple of things to add to swlondonmum's informative post - I'm pretty sure you can leave sooner than 8 months pregnant and still get maternity pay. I left work when I was 29 weeks pregnant myself and still got my full rights to maternity pay. There is some date that you need to work up until in order to be eligible but I'm sure it's not as late as 8 months.

I'm also pretty sure that you need to have worked for an employer for a certain amount of time by a certain number of weeks pregnant (e.g. something like you have to have worked for them for a year by the time you are 20 weeks pregnant) in order to have right to get maternity pay from them - though not sure how this works with statutory government maternity pay.

Yes, I think you can leave sooner than 8 months and still be eligible for Maternity pay, but it depends how long you have been working for her.

She also has to be careful in terms of getting rid of you. Yes, she can claim that she needs a live-in nanny, but she has to be careful because as a pregnant woman you could easily claim unfair dismissal, especially ash she isn't being sensitive to your situation.
