Hello

The judge dismissed the case and ordered Gladstones to pay me costs (£95) - in short the signage wasn’t clear at all so they had no case

Search for “ gladstones” “claim” at money saving expert forum in the parking section and you’ll find my original thread plus lots of good advice.

The 10 mins for pick up is almost impossible to stick to and needs to be changed to 20mins. Trains are often delayed.
When I have dropped somebody and needed to go to the platform with them, I have paid parking to avoid a fine.

HI all, I have a fine from Jan 2019 which I had appealed and lost....it had all gone quiet but I am now being chased by a debt recovery agency. I was at the car park for 11mins, waiting for my 12 year old, it was dark his train was delayed (I had no purse or means of payment anyway) and I had no idea the rules had changed and the signs were, at that time, unclear and it was prior to the 10mins sign noted above. JUst in case I get chased, does anyone still have photos of the signs as they were and also details of the DVLA link to complain?

Look on facebook for private parking fines you will be advised well.Signage with terms and conditions are important as form contract.The advantage also of station carpark are bylaws which means they only have  6 month to take you to court not 6 years as with other private parking. You just play letter table tennis with them on points of law with max time between each reply until 6 months is up!

I read thier notice and it was confusing guidance regarding public holdays and Sunday parking, I assume they were advise Free on these days but no they they fined me £100 for picking up more daughter from D&E on a Sunday. Such nice people.

Just to provide an update. I was prepared to see my case all the way through. The car park management company failed to pay the court fee (presumably they reviewed all the evidence I uploaded) so the judge vacated the case.

If anybody is going through the same thing then feel free to reach out and I'll assist as best I can! ;)

Hi all, I have just received a parking charge notice letter for the shop stop clapham junction. I was in the car park for 17 mins for drop-off/pick-up and wasn't aware there was now a 10 min limit. Having read this thread, it confirms my memory that this wasn't always the case. I'm considering appealing, but only have a few days left. I plan to go to the car park tomorrow to check the signage. My letter is from 'parkmaven'. It says that i can pay or appeal at www(dot)parkmaven(dot)com/pcn. Any advice gratefully received.

I'm not sure when parkmaven took over. From google streetview, it appears sometime between June 2021 and July 2022. Does anyone have any experience with their appeals?

I have now taken pics of all the relevant signage that I could see (attached below, in case useful for anyone else). I can't be sure if the signage was the same when I used the car park in early sept. It doesn't mention any rules around drop-off and pick-up, or the 10 min limit anywhere on signage or in my PCN. All our car parks have a consideration period during which we will not issue a ticket. This is to allow motorists time to understand the terms and conditions of the car park, and decide whether they want to park.  By parking, waiting or otherwise remaining within the car park, past the industry standard consideration period of 10 minutes, the driver is agreeing to abide by the terms and conditions of the Parking Contract.  Therefore, regardless of whether a parking event occurred, if a vehicle remains within the carpark for longer than 10 minutes, and is not validated for the full duration of its’ stay, it has failed to comply with the terms of parking, and as such means the driver accepts liability to pay the fee for unauthorised parking. 

I'm thinking to perhaps appeal, stating that I had no idea the rules around drop-off/pick-up had changed (can see on street view that it used to say "Station drop-off and pick-up point" at the car park entrance. No signage to inform people that the rules had changed or that there was a 10 min limit. First offence, despite being a long term local resident and having used the car park many times. Would have been happy to buy ticket if I had been informed of the limit. Now that I am aware, will pay ticket in future, if stay more than 5 mins (to be safe). Appeal for leniency. 

OR... do people think I'd be better to come down heavy (as some have suggested earlier in the thread) stating that I'm not paying intend to take it all the way. Include local councillors / MP / CJ action group etc.  

Any advice gratefully received.

I read somewhere that private car parks cannot pursue you if they don't have evidence that you were the person driving the car - so that if you don't acknowledge the ticket they have no one to pursue for breach of contract as they can't prove it was specifically you. Not sure if that's an urban myth.  Public parking such as councils are covered by different laws I believe.

Thank you Megan. I read something similar, although I think the law changed back in 2012(?) and as long as the private parking company (PPC) belongs to one of the two trade associations (either the IPC or the BPA), then they can pursue the keeper (i.e. the owner?) of the car for the fine by obtaining the address from the DVLA. Unfortunately, the PPC in this case, ParkMaven, are members of the BPA.
